A brief description of Bills of Lading
This is a speciment of a bill of lading form which is used as a primary voyage charterparty contract for every sea transportation today. Its primary functions are :
- it is very good evidence of the contract of affreightment, though not the contract itself,
- it is a receipt for the goods shipped and contains certain admissions as to their quantity and condition when put on board,
- it is a document of title, without which delivery of the goods cannot normally be obtained,
- it can be used as a 'quasi negotiable' instrument.
